Bu yaz\u0131m\u0131zda daha \u00e7ok, s\u00fcnnetin aktar\u0131lma \u015fekline <em>-ba\u015fka bir ifadeyle-<\/em> rivayet \u015fekli itibar\u0131yla s\u00fcnnetin taksimat\u0131na odaklanaca\u011f\u0131z.<\/p>\n\n\n\n<p>F\u0131kh\u0131n bir kayna\u011f\u0131 olan s\u00fcnnet, Kur\u2019an \u00fczerinde a\u00e7\u0131klay\u0131c\u0131, tahsis edici ve&nbsp;takyid&nbsp;edici bir i\u015fleve sahiptir.&nbsp;Kur\u2019an\u2019da olmayan baz\u0131 h\u00fck\u00fcmleri de i\u00e7ermesi a\u00e7\u0131s\u0131ndan Kur\u2019an\u2019dan sonra \u00e7ok \u00f6nemli bir kaynakt\u0131r. S\u00f6z konusu bu kaynak, rivayet \u015fekli bak\u0131m\u0131ndan \u00fc\u00e7e ayr\u0131l\u0131r. M\u00fctevatir haber kendi i\u00e7inde <strong><em>lafzi&nbsp;<\/em><\/strong>ve<strong><em>&nbsp;manevi&nbsp;<\/em><\/strong>olmak \u00fczere iki k\u0131sma ayr\u0131l\u0131r. Lafzi m\u00fctevatir, bir haberin ayn\u0131 laf\u0131zlarla rivayet edilmesidir. Manevi m\u00fctevatir ise bir haberin farkl\u0131 laf\u0131zlarla da olsa ayn\u0131 anlama gelen laf\u0131zlarla rivayet edilmesidir. Hz. Peygamber\u2019in dua ederken ellerini a\u00e7arak yukar\u0131 kald\u0131r\u0131ld\u0131\u011f\u0131na dair rivayetler, manen m\u00fctevatir haber \u00f6rne\u011fidir.<\/p>\n\n\n\n<h3><span id=\"Meshur_Sunnetnbsp\"><strong>Me\u015fhur S\u00fcnnet&nbsp;<\/strong><\/span><\/h3>\n\n\n\n<p>Me\u015fhur haber, sahabe aras\u0131nda ahad iken, sonraki iki nesilde yayg\u0131nl\u0131k kazanarak yalan \u00fczerine anla\u015fmalar\u0131 d\u00fc\u015f\u00fcn\u00fclemeyen bir topluluk taraf\u0131ndan nakledilen haberdir. Hanefilere g\u00f6re me\u015fhur haber, m\u00fctevatir derecesindedir.<\/p>\n\n\n\n<h3><span id=\"Ahad_Sunnetnbsp\"><strong>Ahad S\u00fcnnet&nbsp;<\/strong><\/span><\/h3>\n\n\n\n<p>Ahad s\u00fcnnet veya <strong><a href=\"https:\/\/islamansiklopedisi.org.tr\/haber-i-vahid\" target=\"_blank\" rel=\"noopener\">haber-i&nbsp;vahid<\/a><\/strong> olarak adland\u0131r\u0131lan bu s\u00fcnnet, ikinci ve \u00fc\u00e7\u00fcnc\u00fc nesilde tevat\u00fcr say\u0131s\u0131na ula\u015fmam\u0131\u015f yani yalan \u00fczerinde anla\u015fmalar\u0131 d\u00fc\u015f\u00fcnebilen say\u0131daki ki\u015filer taraf\u0131ndan nakledilmi\u015f haberleri kapsar.<\/p>\n\n\n\n<h4><span id=\"Haber-i_Vahid_Ile_Istidlal\"><strong>Haber-i V\u00e2hid \u0130le \u0130stidlal<\/strong><\/span><\/h4>\n\n\n\n<p>Burada hemen belirtmek gerekir ki, haber-i vahid zann\u0131 gerektirir. Dolay\u0131s\u0131yla h\u00fcccet olmas\u0131 noktas\u0131nda birtak\u0131m ayr\u0131mlar s\u00f6z konusudur. \u0130tikatta zan i\u00e7eren \u015fey, h\u00fcccet kabul edilmez. Fakat amel s\u00f6z konusu oldu\u011funda zan yeterli g\u00f6r\u00fcl\u00fcr. Bu itibarla, Kur\u2019an\u2019\u0131n haber-i&nbsp;vahid&nbsp;sebebiyle terkedilmesi caiz de\u011fildir.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong><em>\u201cHz. Peygamber, bir \u015fahit ve yeminle h\u00fckmetti.\u201d<\/em><\/strong><\/p><\/blockquote>\n\n\n\n<p>\u0130mam \u015eafii, <em>-mali konularda-<\/em> davac\u0131n\u0131n yemini ve bir \u015fahit ile h\u00fck\u00fcm verilebilece\u011fi konusunda bu hadisi tutmu\u015ftur. Ebu Hanife\u2019ye g\u00f6re ise, hi\u00e7bir hususta \u015fahit ve yemin ile h\u00fck\u00fcm verilemez. \u00c7\u00fcnk\u00fc bu haber,&nbsp;<strong><em>\u201cEy inanalar! Belirli bir s\u00fcreye kadar bir bor\u00e7 ili\u015fkisine girdi\u011finiz zaman onu yaz\u0131n&#8230; Erkeklerinizden iki \u015fahit getirin, e\u011fer iki erkek olmazsa, bir erkek iki kad\u0131n da yeter.\u201d<\/em><\/strong><strong><em><sup>6<\/sup><\/em><\/strong><strong><em>&nbsp;<\/em><\/strong>ayetine&nbsp;ayk\u0131r\u0131d\u0131r.&nbsp;Hanefiler, bu haberin zikredilen ayete birka\u00e7 y\u00f6nden ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrerek bununla amel etmemi\u015flerdir. Bu ayk\u0131r\u0131l\u0131k y\u00f6nleri \u015funlard\u0131r:<\/p>\n\n\n\n<p>Allah bu m\u00fccmeli tefsir ederek, \u015fahit getirme i\u015finin iki \u015fekilde yap\u0131labilece\u011fini belirtmi\u015ftir. Bunlardan birincisi&nbsp;<strong><em>iki erke\u011fin \u015fahitli\u011fi<\/em><\/strong><strong>,&nbsp;<\/strong>ikincisi de&nbsp;<strong><em>bir erkek, iki kad\u0131n\u0131n \u015fahitli\u011fi&nbsp;<\/em><\/strong>\u015feklindedir. Bu tefsir, s\u00f6z konusu iki se\u00e7ene\u011fin birbirine e\u015fit oldu\u011funu veya birincisi olmazsa ikincisinin devreye sokulaca\u011f\u0131n\u0131 bildiriyor olabilir. Her iki halde de emredilen \u015fahit getirme i\u015finin bu iki neviden birine mahsus olmas\u0131 gerekir. Bu durumda,&nbsp;<strong><em>bir \u015fahit ve yemini&nbsp;<\/em><\/strong>\u00fc\u00e7\u00fcnc\u00fc bir \u015fahit getirme \u015fekli saymak, nassa haber-i&nbsp;vahidle&nbsp;ziyade yapmak demektir.<\/p>\n\n\n\n<p>Allah, s\u00f6z konusu ayetin devam\u0131nda,&nbsp;<strong><em>\u201cBu Allah kat\u0131nda daha adaletli, \u015fehadet i\u00e7in daha d\u00fczg\u00fcn ve \u015f\u00fcpheye d\u00fc\u015fmemenize daha yak\u0131nd\u0131r.\u201d&nbsp;<\/em><\/strong>diyerek \u015f\u00fcphenin ortadan kalkaca\u011f\u0131 \u015fahit getirme yolunun en alt \u00e7izgisinin iki erkek veya bir erkek ile iki kad\u0131n\u0131n \u015fahitli\u011fi oldu\u011funu belirtmi\u015ftir. Daha kolay olmas\u0131na ra\u011fmen \u015fahit ve yeminin s\u00f6z konusu edilmemesi, ayetin i\u015faret tarikiyle \u015fahit ve yeminin h\u00fcccet olmad\u0131\u011f\u0131na delalet etti\u011fini g\u00f6stermektedir.<\/p>\n\n\n\n<p><strong><em>2-Haber-i&nbsp;<\/em><\/strong><strong><em>vahid<\/em><\/strong><strong><em>, me\u015fhur&nbsp;s\u00fcnnete ayk\u0131r\u0131 olmamal\u0131d\u0131r.<\/em><\/strong><\/p>\n\n\n\n<p>Hanefi usul kitaplar\u0131nda me\u015fhur s\u00fcnnete muhalefet gerek\u00e7esiyle reddedilen hadise \u00f6rnek olarak&nbsp;<strong><em>\u201c\u015eahit ve yemin ile kaza\u201d&nbsp;<\/em><\/strong>hadisi \u00f6rnek olarak verilebilir. Hanefiler bu hadisin,&nbsp;<strong><em>\u201c<\/em><\/strong><strong><em>Beyyine<\/em><\/strong><strong><em>&nbsp;davac\u0131ya, yemin daval\u0131ya\u201d&nbsp;<\/em><\/strong>me\u015fhur hadisine ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrm\u00fc\u015flerdir.&nbsp;Beyyine&nbsp;hadisinde,&nbsp;beyyinenin&nbsp;davac\u0131ya, yeminin daval\u0131ya ait oldu\u011fu ifade edilmekte, \u015fahit ve yemin hadisinde ise, bir \u015fahit ve davac\u0131n\u0131n yemini ile h\u00fck\u00fcm verilebilece\u011fi belirtilmektedir.<\/p>\n\n\n\n<p><strong><em>3-Sahabe bu haberle&nbsp;<\/em><\/strong><strong><em>ihticac<\/em><\/strong><strong><em>&nbsp;ve amel etmi\u015f olmal\u0131d\u0131r.<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>\u201cBirinizin kab\u0131n\u0131 k\u00f6pek yalad\u0131\u011f\u0131 zaman onu d\u00f6ks\u00fcn, sonra biri toprakla olmak \u00fczere onu yedi defa y\u0131kas\u0131n.\u201d&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>Ebu&nbsp;Hureyre&nbsp;rivayet etti\u011fi bu hadisin aksine amel ederek kab\u0131n\u0131 \u00fc\u00e7 defa y\u0131kam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong><em>\u201cYetimlerin mallar\u0131nda hayr\u0131 g\u00f6zletiniz ki, zek\u00e2t onu yiyip bitirmesin.\u201d<\/em><\/strong><\/p><\/blockquote>\n\n\n\n<p>Hanefiler bu hadisle amel etmeyi\u015f sebeplerini \u015f\u00f6yle a\u00e7\u0131klam\u0131\u015flard\u0131r: Sahabe \u00e7ocu\u011fun mal\u0131nda zek\u00e2t gerekip gerekmedi\u011fi hususunda ihtilaf etmi\u015fler ve bu hadisi hi\u00e7 s\u00f6z konusu etmemi\u015flerdir. Bu durum hadisin sabit olmad\u0131\u011f\u0131n\u0131 g\u00f6sterir. E\u011fer sabit olsayd\u0131 aralar\u0131nda yay\u0131l\u0131r ve kar\u015f\u0131 g\u00f6r\u00fc\u015fte olanlara kar\u015f\u0131 \u00f6ne s\u00fcr\u00fcl\u00fcrd\u00fc.<\/p>\n\n\n\n<p><strong><em>4-Rivayet, \u00e7ok s\u0131k tekrarlanan ve herkesi ilgilendiren bir olayla (<\/em><\/strong><strong><em>Umumu\u2019l<\/em><\/strong><strong><em>&nbsp;<\/em><\/strong><strong><em>Belva<\/em><\/strong><strong><em>)<\/em><\/strong>&nbsp;<strong><em>alakal\u0131 olmamal\u0131d\u0131r.&nbsp;<\/em><\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong><em>\u201cHz. Peygamber&nbsp;r\u00fck\u00fbya&nbsp;giderken ve ba\u015f\u0131n\u0131 r\u00fckudan kald\u0131rd\u0131\u011f\u0131 zaman ellerini kald\u0131r\u0131rd\u0131.\u201d<\/em><\/strong><\/p><\/blockquote>\n\n\n\n<p>Hanefiler bu gibi durumlarda&nbsp;ahad&nbsp;tarikiyle rivayet edilen hadisleri kabul etmez ve onlarla amel etmezler. Bu sebeple onlar yukar\u0131da verilen Abdullah bin \u00d6mer hadisiyle amel etmemi\u015flerdir. Zira namaz her g\u00fcn tekrarlanan ve cemaat halinde tekrarlanan bir ibadettir. \u015eayet b\u00f6yle bir s\u00fcnnet olsayd\u0131 Hz. Peygamber ile namaz k\u0131lan herkesin bunu nakletmesi gerekirdi.&nbsp;Bu durum ayn\u0131 \u015fekilde cehri namazlarda besmelenin a\u00e7\u0131ktan okundu\u011fu hadisi i\u00e7in de ge\u00e7erlidir.<\/p>\n\n\n\n<p>Malikiler, haber-i vahidin Medine ehlinin ameline ters d\u00fc\u015fmemesini \u015fart ko\u015fmu\u015flard\u0131r. \u0130mam \u015eafii ise hadisin senedinin sahih ve muttas\u0131l olmas\u0131n\u0131 \u015fart ko\u015fmu\u015ftur.
