Sosyal hayat\u0131 pratik f\u0131k\u0131h bilgisi y\u00f6nlendirdi\u011fi i\u00e7in ulema yapt\u0131klar\u0131 i\u00e7tihatlar\u0131n neticelerini tedvin etmi\u015flerdir. Bu durum hem f\u0131k\u0131h ilminin f\u00fcru k\u0131sm\u0131n\u0131n geli\u015fmesine sebep olmu\u015f hem de mezheplerin te\u015fekk\u00fcl s\u00fcrecine ivme kazand\u0131rm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Metodik kitaplar\u0131n yani usul kitaplar\u0131n\u0131n f\u00fcru eserlere g\u00f6re gecikmesinin nedeni usul y\u00f6nteminin zaman i\u00e7erisinde geli\u015fmesidir. Yani bug\u00fcn fukaha, m\u00fctekellim ve memzuc olarak tasnif etti\u011fimiz f\u0131k\u0131h usul\u00fc y\u00f6ntemlerinin f\u0131k\u0131h \u00fcretiminin ba\u015f\u0131nda olu\u015fmamas\u0131d\u0131r. Zamanla fakihlerin e\u011filim ve y\u00f6nelimleri bu metotlar\u0131n ortaya \u00e7\u0131kmas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Bu metotlar\u0131n vukuundan \u00f6nce yaz\u0131lan ilk eser \u0130mam \u015eafii\u2019nin (\u00f6. 204\/820) er-Risale\u2019sidir. Tarihsel bazda \u00e7ok erken sudur eden bu eseri takip eden sonraki kaynaklar\u0131n yakla\u015f\u0131k bir as\u0131r sonra ortaya \u00e7\u0131kt\u0131klar\u0131n\u0131 g\u00f6r\u00fcyoruz. Bunun nedeni arada ge\u00e7en s\u00fcrede mezheplerin te\u015fekk\u00fcl etmesi ve i\u00e7tihatlar\u0131n belirli bir e\u011filim kazanmas\u0131d\u0131r.<\/p>\n\n\n\n<p>er-Risale\u2019yi takip eden usul kitaplar\u0131n\u0131n ortak noktas\u0131 ise mezhep ba\u011flant\u0131lar\u0131 olmas\u0131d\u0131r. Yani yukar\u0131da bahsetti\u011fimiz fukaha, m\u00fctekellim ve memzuc y\u00f6ntemlerinin olu\u015fmas\u0131 ve bu usuller ba\u011flam\u0131nda kitaplar\u0131n kaleme al\u0131nmas\u0131d\u0131r. Bu metodik anlay\u0131\u015f\u0131n modern d\u00f6nemlere kadar devam etti\u011fini g\u00f6r\u00fcyoruz. Fakihler usul eserlerini mezheplerine g\u00f6re yazm\u0131\u015flar ve kendi mezheplerinin i\u00e7tihat yapma y\u00f6ntemleri \u00fczerinden ilmin geli\u015fimine katk\u0131 sa\u011flam\u0131\u015flard\u0131r.<\/p>\n\n\n\n<p>Modern d\u00f6neme geldi\u011fimizde ise mezhepsel e\u011filimin son buldu\u011funu g\u00f6r\u00fcyoruz. Di\u011fer t\u00fcm \u0130slami sahalarda oldu\u011fu gibi bu sahada da t\u00fcm y\u00f6ntemlerin mezcedilmesini bir t\u00fcr reform aray\u0131\u015f\u0131 olarak telakki edebiliriz. F\u0131k\u0131h usul\u00fcnde modern yaz\u0131m metodu diyebilece\u011fimiz bu usul ilk defa Muhammed el-Hudari\u2019nin (1872-1927) eseri ile ortaya \u00e7\u0131km\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Hudari, Usul\u00fc\u2019l-F\u0131kh ad\u0131n\u0131 koydu\u011fu eseri ile f\u0131k\u0131h\u00e7\u0131lar\u0131n \u00f6n\u00fcn\u00fc a\u00e7m\u0131\u015ft\u0131r. En ba\u015fta mezhep y\u00f6neliminden uzak bir \u015fekilde kaleme alm\u0131\u015f bu eseri ile en sade bi\u00e7imde usul-\u00fc f\u0131kh\u0131 anlatmak istemi\u015ftir. Sonraki yazarlar da Hudari\u2019nin a\u00e7m\u0131\u015f yolda yeni eserler telif ederek literat\u00fcr\u00fcn geli\u015fimine katk\u0131 sa\u011flam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Zekiy\u00fcddin \u015eaban\u2019\u0131n \u0130slam Hukuk \u0130lminin Esaslar\u0131 \u015feklinde terc\u00fcme edilen Usul-\u00fc F\u0131k\u0131h eseri de modern y\u00f6nelimle kaleme al\u0131nan kitaplardan bir tanesidir.<\/p>\n\n\n\n<p>\u00d6ncelikle eserimizin hedef kitlesi sadece \u0130slami ilimler e\u011fitimi alan yani ilmi alt yap\u0131s\u0131 bulunan kesim de\u011fil, M\u00fcsl\u00fcman olan herkestir. Zekiy\u00fcddin \u015eaban eserinin muhatap kitlesini geni\u015f tuttu\u011fu i\u00e7in ele ald\u0131\u011f\u0131 konular\u0131 derinlikli \u015fekilde i\u015flemek yerine y\u00fczeysel bi\u00e7imde a\u00e7\u0131klamay\u0131 tercih etmi\u015ftir. Ki Hudari\u2019nin ba\u015flatm\u0131\u015f oldu\u011fu hareketin temel \u00f6zelliklerinden bir tanesi budur.<\/p>\n\n\n\n<p>Di\u011fer taraftan klasik eserlerde oldu\u011fu yo\u011fun bir kullan\u0131m\u0131 s\u00f6z konusu de\u011fildir. Dilin basitli\u011finin yan\u0131nda \u0131st\u0131lah kullan\u0131m\u0131n\u0131n da yerli yerinde oldu\u011funu s\u00f6yleyebiliriz. Mukaddimede m\u00fcellif \u00f6nceki yazarlar\u0131n teliflerinde icaz sanat\u0131n\u0131 \u00e7ok fazla kulland\u0131klar\u0131n\u0131 ve metni anlaman\u0131n imk\u00e2ns\u0131z hale geldi\u011fini, b\u00f6ylelikle kitab\u0131 okuman\u0131n bir bilmece \u00e7\u00f6zmeye benzedi\u011fini ifade etmi\u015ftir. \u015eerh, ha\u015fiye, talik gibi \u00e7al\u0131\u015fmalar\u0131n da m\u00fcelliflerin bu tutumundan ileri geldi\u011fini belirmi\u015ftir. Bu sebeple kendi eserinde son derece a\u00e7\u0131k bir \u00fcslup ve basit bir dil kullanarak, k\u0131saca lisan sanatlar\u0131ndan uzak durarak konuyu en iyi \u015fekilde anlatmay\u0131 tercih etmi\u015ftir.<\/p>\n\n\n\n<p>Zekiy\u00fcddin \u015eaban da di\u011fer modern eserler gibi mezhep y\u00f6neliminde olmadan eserini genel bir \u00e7er\u00e7eve i\u00e7erisinde yazm\u0131\u015ft\u0131r. Yani f\u0131k\u0131h usul\u00fc metotlar\u0131ndan azade, sadece kavramlar\u0131 ve konular\u0131 anlatmaya y\u00f6nelik bir y\u00f6ntem izlemi\u015ftir. Eserin pop\u00fclaritesini art\u0131ran en \u00f6nemli taraflar\u0131ndan biri budur.<\/p>\n\n\n\n<p>Nitekim eserimiz bug\u00fcn hem \u0130slami ilimler e\u011fitimi veren kurumlar da hem de ilahiyat fak\u00fcltelerinde okutulmaktad\u0131r.
