Mahmud el-Mevs\u0131li (\u00f6. 683\/1284)<\/em><\/p><\/blockquote>\n\n\n\n<p><strong>Genel Tan\u0131t\u0131m<\/strong><\/p>\n\n\n\n<p>el-Mevs\u0131li (\u00f6. 622\/1225), Hanefi mezhebinin \u00f6nde gelen fakihlerinden biridir. Eserleri mezhebin kaynak kitaplar\u0131d\u0131r. Bu sebeple mezhep i\u00e7erisinde ashabu\u2019t-temyiz yani g\u00f6r\u00fc\u015flerin kuvvetli olanlar\u0131n\u0131 zay\u0131flardan ay\u0131rt edebilecek yetkinli\u011fe sahip f\u0131k\u0131h\u00e7\u0131lardan say\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>el-\u0130htiyar, asl\u0131nda Mevs\u0131li\u2019nin daha \u00f6nceleri yazm\u0131\u015f oldu\u011fu el-Muhtar li\u2019l-Fetva isimli eserinin \u015ferhidir. Bu sebeple \u00f6ncelikle el-Muhtar\u2019\u0131 anlamak faydal\u0131 olacakt\u0131r.<\/p>\n\n\n\n<p>el-Muhtar, Mevs\u0131li\u2019nin gen\u00e7lik d\u00f6nemlerinde kaleme alm\u0131\u015f oldu\u011fu bir eserdir. Risale ebad\u0131ndad\u0131r. Sebeb-i telifi ise kendisinden b\u00f6yle hacimsiz, ders olarak okutulabilecek bir kitap istenmesidir. O da m\u00fcbtediler i\u00e7in b\u00f6yle bir eser kaleme alm\u0131\u015ft\u0131r. Ve Hanefi mezhebin temel kitaplar\u0131 olan \u201cm\u00fctun-i erbaa\u201ddan say\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Kitab\u0131n amac\u0131 Ebu Hanife\u2019nin (\u00f6. 150\/767) g\u00f6r\u00fc\u015flerinin derlenmesidir. Bu sebeple temelde \u0130mam Azam\u2019\u0131n f\u0131khi g\u00f6r\u00fc\u015flerine yer verilmi\u015ftir. Fakat yer yer Ebu Yusuf (\u00f6. 182\/792), \u0130mam Muhammed (\u00f6. 189\/805) ve \u0130mam \u015eafii\u2019nin (\u00f6. 204\/820) de muhtelif g\u00f6r\u00fc\u015fleri zikredilmi\u015ftir. Eserin ra\u011fbet g\u00f6rmesi neticesinden yine m\u00fcellif taraf\u0131ndan \u015ferh edilmi\u015ftir.<\/p>\n\n\n\n<p>\u0130\u015fte el-\u0130htiyar li-Ta\u2019lili\u2019l-Muhtar isimli eser, yukar\u0131da ele alm\u0131\u015f oldu\u011fumu el-Muhtar risalesinin geni\u015fletilmi\u015f halidir.<\/p>\n\n\n\n<p>el-\u0130htiyar\u2019\u0131n sebebi telifi ise el-Muhtar ile ayn\u0131d\u0131r. Risalenin ders i\u00e7in \u00e7ok elveri\u015fli olmas\u0131 talebeler taraf\u0131ndan sevilmesi sonucunda yine m\u00fcelliften bu eserin biraz daha detayl\u0131 bir versiyonunun yaz\u0131lmas\u0131 istenmi\u015ftir. O da kendi eserini geni\u015fletmi\u015ftir.<\/p>\n\n\n\n<p>el-\u0130hitiyar, el-Muhtar\u2019da ele al\u0131nan konular\u0131n, h\u00fck\u00fcmlerin illet ve delillerinin de eklenmesi ile olu\u015fmu\u015ftur. Di\u011fer taraftan eserde sadece Hanefi mezhebinin di\u011fer sair mezheplerin de g\u00f6r\u00fc\u015flerine, tenkitlerine yer verilmi\u015ftir. S\u0131k\u00e7a sorulan sorular i\u00e7in ayr\u0131 bir b\u00f6l\u00fcm i\u00e7in a\u00e7\u0131lm\u0131\u015f ve bu sorular cevaplanm\u0131\u015ft\u0131r. Fetvalar aktar\u0131lm\u0131\u015ft\u0131r.
