Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda f\u0131k\u0131h usul\u00fcn\u00fcn f\u0131kh\u0131n \u201cmutfak\u201d k\u0131sm\u0131n\u0131 ifade etti\u011fini s\u00f6yleyebiliriz.<\/p>\n\n\n\n<p class=\"has-text-align-left\">F\u0131k\u0131h usul\u00fc ilmi, iki kelimeden olu\u015ftu\u011fu i\u00e7in iki farkl\u0131 \u015fekilde tan\u0131mlan\u0131r. Bu sadece bu ilme has bir durum de\u011fildir. Genelde birka\u00e7 kelimeden olu\u015fan ilimler farkl\u0131 tan\u0131mlamalarla kar\u015f\u0131m\u0131za \u00e7\u0131kar. Bu tan\u0131mlamalar <strong><em>tafsili<\/em><\/strong> ve <strong><em>icm\u00e2li tan\u0131m <\/em><\/strong>olmak \u00fczere iki \u015fekilde olur. Tafsili tan\u0131mlar terkipte bulunan kelimelerin teker teker a\u00e7\u0131klanmalar\u0131yla ger\u00e7ekle\u015fir. \u0130cmali tan\u0131mlar ise kelimelerin teker teker a\u00e7\u0131klanmay\u0131p bir b\u00fct\u00fcn haliyle a\u00e7\u0131klanmas\u0131 \u00fczerinden ger\u00e7ekle\u015fir.<\/p>\n\n\n\n<p><strong>F\u0131k\u0131h Usul\u00fc \u0130lminin Tafsili Tan\u0131m\u0131: <\/strong>F\u0131k\u0131h, <em>\u201c\u015eer\u2019i amel\u00ee h\u00fck\u00fcmleri tafsili delillerinden hareketle bilmek\u201d <\/em>demektir. Usul ise dayanak, bir ba\u015fka ifadeyle \u201cdelil\u201d anlam\u0131nda kullan\u0131l\u0131r. M\u00fc\u00e7tehit bir kimse i\u00e7in f\u0131k\u0131h usul\u00fc, bir k\u0131lavuz g\u00f6revi g\u00f6r\u00fcr. M\u00fc\u00e7tehit olmayan birisi i\u00e7in ise, h\u00fck\u00fcmlerin hangi esaslara g\u00f6re ortaya \u00e7\u0131kt\u0131\u011f\u0131n\u0131 bildirir. Ba\u015fka bir ifade ile i\u015fin arka plan\u0131n\u0131 net bir \u015fekilde ortaya koyar.<\/p>\n\n\n\n<h3><span id=\"Fikih_Usulunun_Tedvini_ve_Tedvin_Metotlari\"><strong>F\u0131k\u0131h Usul\u00fcn\u00fcn Tedvini ve Tedvin Metotlar\u0131<\/strong><\/span><\/h3>\n\n\n\n<p><strong><a href=\"https:\/\/islamansiklopedisi.org.tr\/usul-i-fikih\" target=\"_blank\" rel=\"noopener\">F\u0131k\u0131h usul\u00fc<\/a> <\/strong>ilminin tedvini <a href=\"https:\/\/islamansiklopedisi.org.tr\/safii\" target=\"_blank\" rel=\"noopener\"><strong>\u0130mam \u015eafii<\/strong>\u2019<\/a>nin Er-Risale adl\u0131 eseriyle ba\u015flar. Burada en \u00e7ok kar\u0131\u015ft\u0131r\u0131lan \u015fey, f\u0131k\u0131h usul\u00fcn\u00fcn \u0130mam \u015eafii ile ba\u015flad\u0131\u011f\u0131d\u0131r. F\u0131k\u0131h usul\u00fc ilminin ortaya \u00e7\u0131k\u0131\u015f\u0131 Hz. Peygamber\u2019e (as) kadar dayan\u0131r. Nitekim onun h\u00fck\u00fcm vazederken izledi\u011fi baz\u0131 esaslar\u0131n var oldu\u011funu g\u00f6rebiliyoruz. \u0130mam \u015eafii\u2019nin Er-Risale\u2019sinin bu denli \u00f6ne \u00e7\u0131kmas\u0131n\u0131n en b\u00fcy\u00fck sebebi kendisine kadar olan d\u00f6nemde f\u0131k\u0131h usul\u00fc ilminin tedvin edilmemi\u015f olmas\u0131 veya kendisinden \u00f6nce yaz\u0131lm\u0131\u015f bir eser varsa bize ula\u015famam\u0131\u015f olmas\u0131d\u0131r. Dolay\u0131s\u0131yla Er-Risale i\u00e7in f\u0131k\u0131h usul\u00fc ilminin \u201cen eski\u201d veya \u201cilk\u201d eseri dememiz daha do\u011fru bir yak\u0131\u015ft\u0131rma olacakt\u0131r.<\/p>\n\n\n\n<p>Bu girizg\u00e2htan sonra gelelim tedvin metotlar\u0131na. F\u0131k\u0131h usul\u00fc ilminin yaz\u0131m\u0131nda izlenen iki metottan bahsedebiliriz: <strong><em>Fukaha ve m\u00fctekellimun metodu.<\/em><\/strong><\/p>\n\n\n\n<p><strong>Fukaha Metodu:<\/strong> C\u00fcz\u2019\u00ee meselelerden hareketle genel kaidelerin olu\u015fturuldu\u011fu bir metottur. Mant\u0131k ilmindeki t\u00fcmevar\u0131m metodunu an\u0131msat\u0131r. Bu metoda f\u00fcru f\u0131k\u0131h h\u00fck\u00fcmleri h\u00e2kimdir. Fukaha metoduna g\u00f6re yaz\u0131lm\u0131\u015f en \u00f6nemli usul eserleri \u015funlard\u0131r:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>1-<em>El-Fusul fi\u2019l-usul \u2013 Cessas<\/em><br>2-<em>Takvimu\u2019l edille \u2013 Debus\u00ee<\/em><br>3-<em>El-Usul \u2013 Serahsi<\/em><br>4-<em>Kenzu\u2019l Vusul il\u00e2 Ma\u2019rifeti\u2019l Usul \u2013 Pezdev\u00ee<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Yeri gelmi\u015fken \u015furaya \u015f\u00f6yle bir not d\u00fc\u015felim: <strong>\u201c<\/strong><strong><em>Sonraki d\u00f6nem Hanefi usul kitaplar\u0131n\u0131n geneli esas itibar\u0131yla Pezdev\u00ee\u2019nin usul\u00fcne dayanmaktad\u0131r. Ayr\u0131ca bu esere bir\u00e7ok \u015ferh ve ha\u015fiye yaz\u0131lm\u0131\u015ft\u0131r.\u201d<\/em><\/strong><\/p>\n\n\n\n<p><strong>M\u00fctekellimun Metodu: <\/strong>Bu metotta usul kaideleri delillerden hareketle tespit edilir. Bu bak\u0131mdan mant\u0131k ilmindeki t\u00fcmdengelim metodunu an\u0131msat\u0131r. Bu metoda g\u00f6re yaz\u0131lm\u0131\u015f en \u00f6nemli usul eserleri \u015funlard\u0131r:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>1-<em>El-Umde f\u00ee usuli\u2019l-f\u0131kh \u2013 Kad\u0131 Abdulcebbar (Mutezili)<\/em><br><em>2-El-Mu\u2019temed f\u00ee usuli\u2019l-f\u0131kh \u2013 Ebu\u2019l H\u00fcseyn el-Basr\u00ee (Mutezili)<\/em><br><em>3-El-Burhan f\u00ee usuli\u2019l-f\u0131kh \u2013 C\u00fcveyn\u00ee (\u015eafii)<\/em><br><em>4-El-Mustasf\u00e2 \u2013 \u0130mam Gazali (\u015eafii)<\/em><\/p>\n<\/blockquote>\n\n\n\n<h3><span id=\"Fikih_Usulu_Ilminin_Konulari\"><strong>F\u0131k\u0131h Usul\u00fc \u0130lminin Konular\u0131<\/strong><\/span><\/h3>\n\n\n\n<p>F\u0131k\u0131h usul\u00fc ilmi, t\u0131pk\u0131 di\u011fer ilimler gibi kendi i\u00e7erisinde \u00f6zel bir sistemati\u011fe sahiptir. Bu sistematikte ba\u015fl\u0131klar\u0131n farkl\u0131 taksimleri olsa da sac aya\u011f\u0131 olarak \u015fu \u00fc\u00e7 b\u00fcy\u00fck ana ba\u015fl\u0131k \u00fczerinden <strong><em>usul ilminin konular\u0131n\u0131<\/em><\/strong> genel hatt\u0131yla g\u00f6rebiliriz. Dolay\u0131s\u0131yla istinbat\u0131n ilk ad\u0131m\u0131 bu kaynaklar \u00fczerinden at\u0131l\u0131r. Bu kaynaklar Arap\u00e7a oldu\u011fundan, daha iyi ve do\u011fru anla\u015f\u0131lmalar\u0131 i\u00e7in dilin inceliklerine h\u00e2kim olunmas\u0131 gerekir.
