S\u00f6z konusu tart\u0131\u015fmalar\u0131n merkezinde <strong><a href=\"https:\/\/islamansiklopedisi.org.tr\/safii\" target=\"_blank\" rel=\"noopener\">\u0130mam \u015eafii<\/a> <\/strong>yer al\u0131r. \u0130mam \u015eafii, istihsana bak\u0131\u015f\u0131yla di\u011fer mezhep imamlar\u0131ndan tamam\u0131yla ayr\u0131l\u0131r. Peygamber\u2019den (as) rivayet edilen bir haberden dolay\u0131 terk edilmesidir. Oru\u00e7lu bir kimsenin unutarak yemesi ve i\u00e7mesi durumunda orucunun bozulmamas\u0131n\u0131 buna \u00f6rnek olarak verebiliriz.<\/p>\n\n\n\n<h4><span id=\"Icma_Sebebiyle_Istihsan\"><strong>\u0130<\/strong>cma Sebebiyle \u0130stihsan<\/span><\/h4>\n\n\n\n<p>K\u0131yas\u0131n icma ile sebebiyle terk edilmesidir. Buna \u00f6rnek olarak istisna akdi verilebilir. Normal \u015fartlarda akdin konusu olan \u015feyin akit esnas\u0131nda var olmas\u0131 gerekir. Fakat istisna akdinde b\u00f6yle bir durum s\u00f6z konusu de\u011fildir. Bu ve benzeri akitlerde insanlar\u0131n team\u00fcl\u00fcnden dolay\u0131 k\u0131yas terk edilir.<\/p>\n\n\n\n<h4><span id=\"Zzaruret_Sebebiyle_Istihsan\"><strong>Z<\/strong>zaruret Sebebiyle \u0130stihsan<\/span><\/h4>\n\n\n\n<p>Buna \u00f6rnek olarak icare akdini verebiliriz. Menfaatler mal kapsam\u0131nda de\u011ferlendirilmedi\u011fi i\u00e7in al\u0131m-sat\u0131m\u0131n\u0131n caiz olmas\u0131 s\u00f6z konusu de\u011fildir. Fakat insanlar\u0131n ihtiya\u00e7lar\u0131ndan dolay\u0131 icare akdi, istihsanen caiz g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<h4><span id=\"Orf_Sebebiyle_Istihsan\"><strong>\u00d6<\/strong>rf Sebebiyle \u0130stihsan<\/span><\/h4>\n\n\n\n<p>Burada vak\u0131f meselesini \u00f6rnek olarak verebiliriz. Hanefilere g\u00f6re bir mal\u0131n vakfedilebilmesi i\u00e7in gayrimenkul olmas\u0131 gerekir.
